Filing L2 visa self without company help

my self and my spouse both work for same IT company in india . I am in L1 A visa here and my company is refusing to file L2 for my spouse as she is also an employee for the company. I wanted to know if there is any legal basis for this or this is a pure company policy ? They are asking my spouse to resign and then only they will initiate an L2 visa thats what they are telling.

Can i as a person file L2 for my dependent without going through my company and asking them to file the L2 visa ?

L2 Visa can be applied as an individual if spouse or parent is holding L1A Visa.

Following are the details for applying the L2 Visa:

The following must be submitted:

Completed visa application along with the applicable draft amount
Original valid passport
Two recent color photographs
Original marriage certificate
Four to five marriage photographs in the case of an L-2 spouse.
Copy of the applicant's parent's or spouse's L-1 approval
Parent's or spouse's employment verification letter
Demand draft for visa application fee
Demand draft for visa issuance fee
