  • L2 Visa required for H4 Visa holder?

    Hello All,
    Would be great if you could clarify my query.
    My husband is on H1 Visa and currently in US. Me and my son has H4 visa. We were in US for few months.
    I'm in India now and my company will be applying for L1 visa for me.
    Should I apply for L2 visa for my son.
    When I travel back to US, it is only me and my son will be travelling. Can we have L1 and H4 visa?

    When you travel, you will have to tell the inspection officer which Visa you are using. Your status (I-94) will be accordingly determined.

    Your child has the option of either L2 or H4. If you choose H4, you will need to carry your spouse's H1 documents with you (copies). If you two will live separately while in the US, and the child will live with you, then it is better to use L2.
