  • Valid I-94 but L2 visa expired.

    Hi,
I am in the US on a L2 visa. The visa expires June 2013. When my husband came to the US he got an I-94 with date matching his visa expiry date. When I came with the kids we all got a date of Oct 2015! I know my husband will have to go back in June (He is planning to come back on H1 in Oct 2012) but can I and the kids stay in the US during that time? Or since we are dependents we need to leave as soon as he does? Please advise.
    Thanks.

Anupi - You may not be able to stay in US if your husband goes back as your L2 status ceases to exist as he moves out.

If he is planning to return on H1, your stay is illegal and you must leave with him.
If it was a short term trip and he returns on L1, you can stay.
Please note that when his status changes to H1, L2 becomes void. So you should get H4.
