  • EAD or SSN first for L2 visa holders?

    Hi All,

    Before posting this question here, I have already searched the forum(and some others) for this topic and have found different answers which have increased the confusion
    more.

    I would request experts here to please help me here.

    I am on L2 visa and have landed in the country 2 months back. I would request experts to please advice me on:
    1) Can I apply for SSN before applying EAD card? If yes, then will my SSN have a note saying not authorized to work?(some forums say rules have changed long back and we can apply for SSN without EAD and still SSN wont have any note saying not authorized to work, is that true?)

    2) My husband(on L1) needs to file his 2012 tax returns and we need to know if we should file the tax after I get my SSN? Will it help us to get more tax return?.... [Keeping the fact in place that we got married on December2012 and i landed in US only on January2013(so legally i am his dependent only from 2013)]

    I really appreciate if someone some please advice us on above 2 points.

    -- Yes, you don't need EAD to apply for SSN. The 'not authorized to work without DHS authorization' notation will be there on the card irrespective and it will make no difference to you. Everybody other than GC holders and US Citizens have that notation.

    -- You will need SSN for your husband to claim you as dependent. Since you were legally married in 2012, your husband can claim you as dependent in the 2012 return. It does not matter that you arrived in the US in 2013.

    I really appreciate if someone some please advice us on above 2 points.
