  • L1B will expire on Apr2013; got H1B approval; Have concerns

    Hi,
My L1B will expire on Apr2013 from company A. I applied H1B from company B and it got approved now. So here are my concerns:

    1. As my H1B is active now, Can I work with Company A until I serve the 2 weeks notice period and then move onto H1B? Is that legal to work on L1B while I have valid H1B?
    2. Can I continue with Company A, by asking them to transfer my H1B, so that they dont need to file for L1B extension? Would there be any complications involved?

    Appreciate for your time!

    Thanks,
    Venne

Was your H1 approved as a COS (Change of status) ?
What is the start date in the H1 approval notice? Is there an I94 attached to the bottom of the H1 petition ?

Thank you so much for your prompt response.
      1. My H1 is approved as a COS
      2. It is valid from 3/13/2013.

Please provide me your response at the earliest.
      Appreciate your time,

You should join your H1 employer (B) on 3/13, and should not work for L1 employer after that.
To continue with A, I am not sure whether you have enough time to do the H1 transfer.
You may consult a good immigration attorney to review your case or talk with A's attorney, if they have one.
