L1 to H4

I was on L1B. My I94 has already expired on Dec-2012, now my L1B extension got rejected. Can i apply H4 in premium process? Am i eligible while i am in USA?

There is no premium processing for H4, and with an expired I-94 anyhow a Change of Status is not possible. You should plan to leave ASAP as you are accumulating out of status period.
