Lost I-129S petition, any alternative

I got an L-1B visa in Oct2008. It was valid till Oct2011 and currently in USA on valid I-94 which is valid till Jan 2014. Now Company is filing for COS L1 to H1 for this quota. Company immigration team is asking for I797 and I129 to process my COS L1 to H1 and they don't have any copy of stamped I-129S and I have also lost it somewhere.

I only have the L1 visa stamped on my passport, valid I94 and photocopy of I-129S without stamped.

1. Is there any way, I can obtain the forms again.
2. Sign an affidavit stating that I have lost I-129S and attached this affidavit along with other H1B filing documents.
3. Can I request to USCIS or BCIS thru FOIA request. Will they send me I-129s petition again. If Yes, any idea how much time normally they takes to release.
4. Since my visa has already been expired in Oct 2011 and staying in USA on I-94 whose validity till Jan 2014. Is it really I-129S petition required for COS L1B to H1B for expired L1B visa status.
5. If I don’t submit I-129S petition and file COS L1 to H1. What would happen.

Please suggest me all possible alternative.
