  • Is my L1B valid??? its work-permit expired but stamping date is still valid

    Hi,

I got my L1B stamped in April 2010, visa stamping is approved till April-2015.
But my petition papers (work-permit) were off 3 years and its expiry date is 17-Mar-2013.

Work Permit -- valid till 17-Mar-2013
Visa stamping -- valid till 05-Apr-2015

As per the dates my work-permit got expired 10 days ago. Since my stamping date is still valid, is my visa is Valid?
Can i travel to US and work again?
Is there any procedure to get only work-permit extension for L1B? Please let me know.

Earlier i travelled to US and stayed there for 2 years. But currently i am in India.

    Thanks and Regards,
    Amjad

The USCIS/CBP recently adopted the practice of issuing visa/I94s with a validity of the theoretical L1 length. This means that while the petition will be valid for three years, your visa/I-94 will assume that you will get an extension.

Your employer will need to file for an L-1B extension as soon as possible. You are not authorized to work without a valid I-129.
