  • L2 filing when L1 is about to expire

    Hi,

    My L1 will be expiring in Jun 2013, I m planning to visit India in April and will return in may. Upon my return, I will be filing L2 for my wife. I want to know

    1. Can I file with just 2 months in hand? Will USCIS consider this as normal case or simple won't allow.
    2. If point 1 is not possible, what are my options?

    Any advice will be greatly appreciated.

    Will your wife be applying for L2 Visa at a consulate or will she be applying for change or extension of L2 status?

      My company will be filing for L2 visa for her, it will be processed first time for her.

        It won't be a problem, I did the same for my family in 2012. My L1 I94 was expiring in June, they went for visa interview by end of March and came to US in April.

          Thanks a lot binoca and kabkaba, appreciate a lot for your comments. I am worried coz, i have just 2 months for filing and bringing her here in US. I m not sure if 2 months are sufficient for whole process.

            My wife got an interview date on May 30th, which leaves 30 days on my visa. Should that be a problem during interview or Port of entry. please advise.
