L1 Extension

Hi,

My extension for L1B applied on Sep 27, 2012 for which was due by Sep 29, 2012 and I-94 also the same. Got a RFE on Oct 24, 2012 and responded back on jan16 and the status still remains as RFE response received/review in progress. Just want to check when can we expect the status update? What are the chances of getting the extension.

Well no one can predict the chances. Also, since your I94 has expired on Sep 29 2012 its been over 6 Months, I think its time to upgrade to premium. You have to understand that at this stage if your L1 is rejected the entire 6+ Months stay is considered illegal and out of status period which can possibly be questioned during future visa stampings. Also, one can only work for Max 240 Days after I-94 expiry provided extension was filed in timely manner, so you pretty much have around 50 Odd days remaining to work, after that its illegal even to work.

If you upgrade to premium then you can get a decision within next 15 odd days.

Kalyan - I am in same situation. I have responded to RFE on Jan 30th and till now didn't get my status on my L1B extension. 6months back my VISA/I94 expired and just before my VISA expiry applied for extension. Please let me know if you get any response from USCIS
