L2 I94 extension based on L1 I94 date beyond L1 Visa end date

  • L2 I94 extension based on L1 I94 date beyond L1 Visa end date

    Hi,

    My L1 Visa end date: 23-Apr-2013
    I94 end date: 22-Feb-2014

    Earlier my wife had same I94 end date as mine, she traveled to India due to some emergency and got back on 3-Apr-2013, however this time she received I94 end date as 23-Apr-2013. Please tell me if I can apply for her I94 extension based on primary L1's I94 which is till 22-Feb-2014.

      Since its only 20 odd days, once applied and if decision is still pending by current I94 end date i.e., 23-Apr-13, can she be here on applied status till the time decision comes on application for extension?

        As long as extension request is filed before I94 end date one can stay upto the decision or 240 days whichever is earlier.
