  • 221 (g) in L2-B dependent Visa @ New Delhi Embassy

    Hi,

I am working in US on L1-B visa from last more than a year. I got married (court marriage) on 29th Jan'13 and gone for my wife L2-B visa on 30th Jan'13 for Biometric and 31st Jan'13 for Interview at New Delhi US Embassy office. The interviewee is very much satisfied with my wife's answers and approved her visa and told that you will get your visa along with other papers within 5 working days. They had also given her a green card where it is written as "Your Visa is approved. You will get your passport along with Visa in 5 working days. In case of any query please contact at...... etc".

In the late evening of Interview Day i.e. 31st Jan'13 we got a mail that your case is currently on hold under Section 221(g) of the Immigration and Nationality Act (INA) pending submission of the following documents: Copy of husband's I-797 and copy of husband's visa. We had submitted personally all the respective papers in New Delhi OFC office on 12th Feb'13 and taken an acknowledgement for same.

From that day onwards whenever I am tracking the status of her visa it is always showing under "Administrative Processing". The last update on that is of 31st Jan'13. We tried many times to contact them through phone and mail but didn't got any kind of response. There are no updates from last 64 days.

Can anybody suggest me how can I contact them and expedite the Visa process? How I will get to know when they will approve/declined her visa. Can I initiate another visa process like Visitor visa or a new L2 where one application is already in pending state? Please help me. Your any kind of suggestion is very much valuable for me.

Has your spouse done education in any field under TAL? Such as chemical, bio-tech etc. Maybe your court marriage could be a cause of admin processing, no one say for sure the cause of admin processing.
Unfortunately there is hardly anything you can do but wait. There is no premium processing for dependent visas.

This is my opinion not legal advice.

      Thanks Raghvi for a response.

No, she is a software engineer as like me. I am not able to understand how court marriage may become the cause of AP where we had produced all kind of proofs including marriage certificate with photographs. God knows why they are taking this much of time. Could you please suggest me how can I approach them to get any kind of info on her visa.

      Thanks,
      Rochak
