  • L2 EAD - Not Valid For Reentry To US

    Hi All,

    My L2 Visa is going to get expired soon but I have valid I-94 (Till Next year 08/2014). I have also received EAD renewal based on I-94 Date.
    We are now into process for Visa extension and soon we will be travelling to Canada for New Visa.

    My Question is
    - Will My EAD become invalid if I reenter to US with a new Visa and I-94 since its clearly mention on the card that "Not Valid For Reentry To US"?
    - Do I need to apply for EAD renewal again if I get my Visa extension.

    Kindly Suggest.

    You can use the same EAD.

      Your EAD will still be valid. The reason why your EAD says "Not Valid For Reentry to US" is because it does not serve as an advance parole.

      When someone applies for AOS (I-485) based on an approved family or employment based immigrant petition (I-130 or I-140), that person can also apply for an EAD and advance parole while the AOS is pending. In order to avoid people carrying two documents, the USCIS will, upon approval of the EAD and AP petitions, issue an EAD with a note saying "SERVES AS I-512 ADVANCED PAROLE" on the bottom of the document.

      The "Not Valid For Reentry to US" indicates that the card is not an EAD+AP combo, but a stand-alone EAD.
