  • Appointment for L2 Visa

    Hi,

I am currently in the US with a L1 visa and my wife is going to apply for the L2 visa but we are a bit lost regarding the process.

1- Should I submit the DS-160 (as a primary applicant) or is it the spouse who should submit it?
2- It is not very clear how to apply for an appointment. Should my wife apply as a primary applicant or should I apply and add her as a family member? I am not sure how to proceed since I already have the L1 and I don't need an appointment.

Is she the primary applicant and she should put my petition number?

    thanks for your help.

If you are not accompanying her, she should separately apply on her own.
This is my opinion and not legal advice.

Your wife is the primary applicant for a dependent visa. So she will have to submit the DS-160 in her own name and use your petition number since you are the primary beneficiary of the petition. She derives her eligibility from your petition, but she is still applying for her own visa. She should bring a copy of the petition, your marriage certificate and your visa to the interview, along with other requested documentation. It would of course be best if you could accompany her to the interview, but this is not required.

Once she has the L-2 visa and has been admitted to the U.S., you can request a social security number after 10 days, as well as an EAD.
