Need to Know about New L1B Visa @ 2nd Time

Hi,

I have my L1B Visa Valid till July 16 2013 ( I got my L1B on July 2010, i.e 3 Years). I have used my L1B Visa (26 Months) for my Stay in USA. since i have travelled 3 times and each time i got my I-94 till July 16 2013 (till my Visa Expiry Date only)

Currently i am in India and I am not able to travel to USA now since i have only 3 Months Valid Visa (Risk @ POE-I may or may not get Extra I-94 Date & L1 Extn).
I have below Questions:
1. I am planning to apply New/Fresh L1B Visa with Same Company after July 2013.(i.e. Once My Current Visa Expired in July 16 2013). Am I eligeble to file/apply new L1B with same Company in August 2013?
2. I have my Current I129S Petition Date as 19-July-2010 to 20-July 2013. If i go for New L1B Visa in August 2013 whether Do i need to wait for one more year to file new L1B?
3. If i go for new L1B in August whether i will consider as new petitioner or they will consider my Petition as Extension (i.e Two More Years ( 3+2)=5 Yrs of L1B Period)
4. Is that Possible to

You can be on L1 Status for 5 Years. So if you need fresh 5 Years L1 you need to stay out of US for an entire year and then process new L1.
1. Yes you are eligible. But as said you will most likely get it only for 2 years.
2. If you want fresh 5 Years yes, you would have to wait one year outside US.
3. As said you will be eligible only for 2 Years.
