L 2 restamping but L 1 is expired.

I would like to have your suggestion and thought process on below mentioned scenario:

My L 1-B visa was expired on December 3rd 2012 and my I-94 expiry date is November 24th 2014. My spouse and daughter are on L 2 and their visa also expired on December 3rd 2012 and their I-94 expiry date is November 24th 2014.

My spouse and daughter would like to travel to India in month of June and would come back by July end.

o Is it possible to have their L2 visa re-stamped on the basis of my I-94 ?

o if yes what are possible risks?

o What documentation will be required for the same?


Please respond on urgent basis as i will need to reserve their tickets soon based upon the response and suggestion received on this post.

If the To Date in your initial I129S is valid at the time of L2 application it would be fine, but it would be best if the L2 visa applicant carries an amended I129S with new dates, I 797 copy, as well as primary L1 I-94 copy, marriage certificate/birth certificate to prove relationship with primary L1, primary L1's pay stubs to prove valid status, a letter from employer stating that you still an active employee should be fine.

This is my opinion, please do consult you company attorney and experts too.

What does your I-797 say? If it says valid indefinitely then probably your dependents can go for L2 visa. Do check with an experienced attorney before taking a decision.

may i know did you apply for restamping of L2 and what documents you submitted and was it approved
