  • L1 B Visa - alternative process for extension

    Hello,
    My L1B visa will expire on Aug 2013. My I-94 is valid until Jan 2016. I need to go to India on vacation on Nov 2013. My employer has told that there are 90% chances that L1B extension will be rejected. So given this:
    1. Is there any other alternative process (say raising an application for green card) to come back to USA after Nov 2013 assuming that L1B visa will be rejected.
    2. If in case my employer applies for L1B extension and my L1B extension is rejected (considering) then can I stay and work in USA until Jan 2016 based on my current valid I-94.

    1.even if you raise a GC application unless its in EB1 category you are looking at 8-10 years to get a green card till then in order to freely travel in an out you would still need a visa.
    2. Yes but you can't freely travel in and out of US.

    Have you thought about converting to L1A?

      Thanks for your suggestions. May I know what would be the advantage if I go for L1A...like how it will help me given the current scenario as mentioned ...

        If you get a successful COS to L1A you can potentially file GC under EB1 and get a GC within a year.

          Thanks again for such a prompt response...
          I know that this might have been discussed several times here...but it would be very helpful if you can provide me some good references (links/docs, etc) where I can find complete information of L1B to L1A COS ...like what are the pre-requisites, duration it takes, etc...
