  • Can I apply L2 Visa individually for my Wife and Kid ?

    Hello Experts...

I need your expert opinion please...

I am in India currently, and have recently got my L1B Petition Approved by my Employer in the US..

My Visa Interview date is in a month from now. After I get my Visa approved, can I apply L2 Visa individually for my Wife and Kid ? Or is it mandatory that ONLY my employer should file their L2 Visa ? Can't I do it on my own ?

I was told by a couple of firms that only the Employer has to file/approve L2 for my dependent wife and kid...

Please help me save my time and unnecessary money given away to 3rd Party Consultancies.

    Regards,
    Raghu

It is your dependents' application. Your employer can only assist them in any case.
This is my opinion and not legal advice.

      Thanks for the quick response...

I was told that I have to pay an additional amount besides the $190 if I have to file through my employer ... Is that correct ?

If I assume that I get my visa on 15-Jun-2013, can I book an interview date for L2 Visa on my own and carry the original docs with me along with my dependents ?

Can I pay the DD or cash directly to the US consulate when I take my dependents along for the Visa Interview ?

      Thanks !!!

There is no such additional fees. Your dependents will have to follow the standard application procedure. Check out https://www.immihelp.com/us-visa-application-procedure/ for more information. Since your interview appointment will be booked through BEP, you will not be able to add the dependents in the same appointment as you. But they can certainly get the same date time as you if available through the standard non-BEP procedure.
This is my opinion and not legal advice.

          Hello,

I and my spouse work for the same company on L1 visa and I plan to apply for my visa change of status to L2 as dependent of my spouse. I need your help to understand answers to following questions:

          1. Can I personally apply for change of visa status or does that needs to be initiated by our employer?
          2. Will USCIS need any documentation from employer before approving L2 visa?
          3. How long does L2 visa processing takes?
          4. Can I apply for employment authorization in parallel to L2 visa application?
          5. How long does EAD processing takes?
          6. Once I file for change of status, am I allowed to travel outside USA or should I wait for approval?

          Thanks for your inputs !!
