L1 to L2 COS while i-94 extension is in progress. my i-94 is expired. - Urgent

Both my visa and I-94 got expired on Jun 01 2013.My comapny has filed L1B to L1A conversion on APR 23, 2013. Everyday i used to track my L1 petition status online and it became RFE on Jun 13th 2013. Now, I might get 3-5 weeks time to respond the RFE and probably it will be denial based on last 3-4 months L1A petions in my company getting denied after RFE status.
My Husband is also in L1B visa and his visa is getting expire in Sep 2013 whereas his I-94 is getting expire on Mar 2015.
We are planning to file L2 for me (Depenedent visa on my Husband's L1B visa). Please let us know Can we file L2 visa right now without any delay as I dont want to go back India ? Will i be able to stay in USA with my husband based on my L2 receipt if any delay happens in L2 respond after L1A denial?

As your I94 has expired you can't do a COS to L2 without first getting a L1 approval. The only other way to get to L2 is to leave US get L2 stamped and return on L2.
