L1B - Filing extension before I-94 expiry (earliest date ?? before I-94 expiry)

    Hi all,

    I am Rajesh, working here in the US on L1-B visa. I have the following questions and appreciate your feedback based on your experience:

    1. What is the earliest date that my company could apply for L1-B extension? (I-94 expires in 21-Dec-2013)

    2. If my company apply for an extension before I-94 expiry (not sure if I could apply 6-months prior to I-94 expiry) and if the extension was denied (denial notice arrives
    before I-94 expiry), would I be eligible to continue my stay until I-94 expiry?

    3. My wife works for another company on L1-A visa. If her company agree to apply GC, would I be automatically eligible to apply GC (through her company)?

      Follow up question to the 3rd one:

      Even though I am on L1-B (and my wife in L1-A working for a different company) and not her dependent, would it be possible for her (or her company) to include me as her dependent?

            1. 6 months before the expiration.

            3. If the company files her green card application, you can apply for the green card with her. Her company will be filing an I-140 and then she will need to file Adjustment of Status. You will also be eligible to file the Adjustment of Status application when she does.
