L1 visa : confusion regarding 1 year in past 3 years rule

I was employed by company X in India from Oct, 2007 to 30 Sep, 2010.I am about to join the company X back on 1st Sep,2013. Am i eligible for L1 visa?

from 01-Sep-2010 till 01-Sep-2013 have you worked with X for 1 Year? if yes you are eligible if not then you are not. You worked with X from 01-Sep-2010 till 30-Sep-2010 in last 3 years hence you are not eligible.Had you joined X on or before 30-Sep-2012 you might have been eligible.

IF you join on 01-Sep-2013 you would gain eiligibilty on 01-Sep-2014, if the rules remain same till 01-Sep-2014.
