L1-B Visa Extension Rejection and I-94 Validity

Hello,

My L1-B Visa was valid until April-2013. I had filed extension and it is denied on 10th July-2013.
I have my I-94 validity until 15th Sep-2015. Can I stay in US or I need to leave the country?

One will have to see the rejection notice but most probably you dont need to leave US. You can stay till your I-94 expiry, but remember, if you travel outside US, in order to re - enter, you need to have a valid visa stamped.

I cant understand why you needed to file for extension when your I-94 was/is valid till 2015? USCIS doesnt extend I-94 when its expiring more than 6 Months in the future. Only lawyers garner money for all the filing and paperwork with no end result.

Yes you can unless specifically mentioned in the rejection notice to not do so.

Suppose, I am in US where my L1B expires in next month and i-94 validity is there 7 more months and my company files for L1B extension tomorrow and application gets rejected within a two months while I am still in US. In this case, my I-94 valid is there for 5 more months and will continue to stand valid even if L1B extension is rejected or I-94 will get void and I will be asked to leave US ASAP.

Please refrain from hijacking an already running thread. As for your question, unless very specifically mentioned in the rejection notice, the I94 would be valid even if the extension is rejected. Also seeing the current trends an L 1 extension decision is taking 4-6 months if not filed as premium.
