  • L1 B Visa filing Enquiry

    Hi,

    My company is going to file a L1 B Visa for me in the next couple of weeks. I would also apply for L2 Visa for my wife and kid. My brother in law (wife's brother) is in the US for many many years and he is a US Citizen. Do I or my wife need to mention this in the DS160 form. Will there be an issue if we do not mention the same in my wife's application form. He is not sponsoring us and this is out first visit to the United States.

    Can this be an issue for procuring the L1 B Visa too ?

    There is a section in DS160 where in you have to mention whether one already has any relatives in US. Your wife's DS-160 should truthfully mention about her brother already being there. It wont do any harm in mentioning this fact. If you dont mention and subsequently get caught it could lead to problem.

      Hi Raghvi,

      Thanks a lot for the above message. Just wanted a clarity on the same. Whether I will also need to fill the same in my DS160 form regarding my Bro in law or it is going to be only my wife who would be mentioning in her DS 160 application form.

        First of all, you should NEVER lie on a visa application. On the DS160, it specifically asks if you have relatives in the U.S Although you can technically say no, both your wife and son cannot say no. Her brother is a relative.

        Also, the L-1 and L-2 is what’s called a dual-intent visa. This means you can get the visa even if do have an intent to immigrate now or later. So, even if her brother had filed for her,
        you all would still be eligible for the L visas.

          Thank you very much for the reply. you are right and everything should be stated in the DS 160 form truthfully. So just to clarify in the DS160 form section for myself - for relatives in the US, can I mention "Brother in Law" and in my wife's DS160 she will mention - "Brother" ? Will that be fine and a good approach?
