  • Need to apply L1 B

    Hi ,

In the upcoming week , I am going to apply a fresh L1 Blanket Visa.

This is the second time I am filing my L1. First time , it was in 2009 and it was approved. Then in last 2012 , I applied for extension and got a very big RFE asking questions mostly related to specialized skills . I send them the response but it was finally denied

So now for this new Visa , I have couple of queries :

1).Will the extension rejection to my old visa negatively impact my new request ? If yes ,then in what sense?
2).Based on the RFE they have sent , it's virtually impossible for any technology to meet their criterion. So what should I take into consideration while preparing the documents for this fresh request ?

    Thanks

L1s have been heavily scrutinized off late.

If there hasnt been much change in the skillsets/technologies/products worked/developed then the chances are slim. You can certainly try your luck and hope a lenient officer takes the interview. But you surely would have to mention about the previous rejection in the new DS-160. You certainly would have higher chances with an L1 individual and certainly much better chances with H1.

This is my opinion not legal advice.

It may if the question comes up. Many times when you are going in for 2nd L-1 Blanket interview, they may say to apply for individual petition. When you say that you have and have been rejected, then the officer may be inclined to deny the visa application. What has your immigration attorney said about applying through Blanket again?
