    HI All,

    Greetings...!

    My Scenario

    Current I-94 Expiry - Aug end 2013
    L1A COS in approved for 2 years (Validity Date: 07/13 - Ending Dae: 07/15) & waiting for the Original Approval notice.

    Is that okay for my spouse to travel out of USA on July 29th 2013? Should she just submit the old(current) I-94 during exit (as we have not got the new I-94 in hand yet) ?
    Due to some immediate Family urgency back in India, my Wife and kid need to travel back this Monday 07/29/2013. I’m staying back though.

    My plan is that once I get her new I-797 (with new I-94 in that), I will leave to India and go for Visa-stamping together with my wife.
    Will there be any problem while she enters back to USA in Sept 2013 ? (submitted the old valid I-94 during exit as new I-94 was not in hand that time)?

    No issues. You can submit the I-94 later on too. And as you are going for fresh stamping when you re enter US in Sept 2013 or later, as it is all of you will get a new I-94.

    To be on safe side, dont lose that I-94 and also keep original/copy of outbound/inbound tickets and boarding passes.
