  • India Travel - L1B visa will expire in June 2014 and I-94 will expire in Dec 2014

    Hi,

I am currently in US on L1B visa which is valid till June 2014 and my I94 is valid till Dec 2014.My passport is valid till Dec 2014 and hence my I94 validity date is also till Dec 2014.

I need to travel to India in feb 2014 for 15 days. Can you please let me know when I return back to US, then at the port of entry are there any chances of my new I 94 validity date to be my visa expiry date i.e. June 2014 or will it be my passport expiry date i.e. Dec 2014?

The reason I am asking is because if my new I 94 expiry date will be June 2014 i.e. visa expiry date, then in such a case I will not have sufficient time for my visa extension process since only three months will be left i.e. March 2014 to June 2014.Can you please advise and let me know your inputs?

No one can predict. But recent experiences of some people have pointed to getting I94 only till visa expiry. But it could be otherwise too. No definite rule is there.

This is my opinion not legal advice.
