L1B to L1A Conversion

Hi,

Am in L1B and applying for L1A visa, got the below mentioned Query. As per my understanding I cannot mention that am working or doing managerial role in L1B visa (specialized knowledge visa ) which am holding right now, but I got the below mentioned RFE related to managerial role duties. Also I never did appraisals to anyone before, Please let me know what i should respond back for this.

Query:

Please provide screenshots of appraisals you have made for all of your subordinates, as well as any available evidence (e.g. screenshots or e-mails) of hiring decisions/recommendations, promotion or removal decisions/recommendations, and vacation or leave approvals you have made for your subordinates.

The evidences they have asked for are some of the basic requirements fulfilled by Managers. In order to apply for L1A you should be doing some or all of these basic tasks.

One can certainly get a promotion while on L1B and do Managerial tasks there is no law prohibiting this. One can also do managerial tasks while being on L1B in addition to specialized skill set related work, there is no law prohibiting that.

You have to provide whatever evidence you have, I am afraid if you dont the L1A might be denied.

I dont think that it will suffice. Just as with L1B you have to first show that you already possess a specialized skill set. One cant say that I need L1B to be used when I get specialized skill set in future. Similarly for L1A you have to first demonstrate that you already are playing a Managerial role and now need to play the same role from US.

can you please post your response to the RFE and result. It will be helpful to people who are in same situation. And also please post if any useful information.
