  • 6 year rule on H1B visa

    Hi,
I came to USA on L2 visa. I then got my H1B visa filed. I know that there is a 6 years rule to H1B visa which says that you have to be out of the country for atleast 1 year once you complete 6 years in USA. My question is, will the time that I was on L2 visa be considered in the 6 years period of my H1b visa ?

No. Time spent in dependent visas such as H4, L2 is not counted towards the 6 Years in US limit.

This is my opinion not legal advice.

I was also working on EAD for few months during the time I was on L2. Even then, that time wont be counted towards the 6 years period?

Only H1 and L1 status counts.
