My Background:
Visa : L1b
Petition Validity : 10/10/2013.
I 94 - Validity : June - 2016.
This is the flow :
1)I am currently working for a Company A since last 7 years and came to US on L1b on Aug-2011.
2)I have applied for Change of status - H1b from L1b in this year 2013 -quota through company B.
3)After Applying H1b I had to travel to India for my brothers marriage in the Month of May-2013 and come back to US in June-2013 on L1b. This time I got the I-94 till June 2016.
4) I was told by Company B that My H1b Application got picked in lottery and petition got approved on May -16th 2013.
My questions are :
1) I applied COS from L1b to H1b, So I have to work with Company B from Oct-1 2013. But What if I want to still work for Company A
Can I work as a contractor for the same client with Company A,though my payrolls run with company-B and after two weeks can my Original employer company A file H1b transfer and get back me in to Company A on H1b.
2) What are the risks with the above approach if its feasible
3) Can I file my GC with the Company A in EB2 or is it better to go for GC with company B for EB2.
4) If i want to continue on L1 - is the only option for me is to go back to India before October 1st and come back again on L1, but In this case since my L1b has expired,its extension or fresh petition has to be applied back in India-get stamped and then come back to India.
5)Since my I-94 number changed after my H1b application was filed what needs to be done If I want to change to Company B on H1b from October -1 2013.
