Can I continue to work in US if L1B extension denied, but I -94 is still valid.

Hi,

My L1B-Individual VISA expires and I-94 on 10 April 2014 and I am planning to file for an extension around November last week or December first week. Can I continue to stay in the US till 10 April 2014 even if my extension gets denied before that?

Extension is filed to extend ones stay beyond the current I-94 expiry, if denied it means that stay beyond the current I-94 expiry has been denied. So in your case if extension is denied, it would only mean you cant stay beyond April 2014. You can certainly stay till April 2014.

Hi Raghivi, Thanks a lot for the information. Since my Visa and I-94 Expires on 10-April-2014, Can I apply for H1B in 2014 Quota if my L1 extension gets denied and continue to work in the US, till I get my H1B approved.

That would be a trickier. Your L1 I94 is going to expire on 10-Apr-2014, and your H1 will be valid only from 01-Oct-2014. So you would need a valid status to work between 10-Apr-2014 and 01-Oct 2014. this can be possible only if you get L1 extension approved .
