Applying L 1B Individual when H 1B withdrawn

Hi All,

Due to some technical error my H 1B petition got filed twice, so i got a NOID (Notice on intent to denial) on my H 1B. To avoid denial my employer withdrew my petition. Now my online status is USCIS website shows as RFE Response Review. My employer is suggesting me to go for L 1B Individual.

My question is can i go ahead with L1B individual in such a scenario ? Though my employer filed a withdrawal notice still online status shows as RFE Response Review. If i aplly for L1 now, will it have any problem?
