  • L2B for same-sex couple

    Hi!

I am French and my husband is Indian. We married in Spain in 2009 and our marriage is valid in the European Union. I received L1B to work in the U.S. through my French company and arrived in Seattle a few months ago (actually, a few days before the DOMA was struck down). I want to sponsor my husband to come join me. I believe USCIS has started to grant visas for same-sex foreign national couples that are eligible. Can someone throw more light on this? Also, is there a set of documents I need. My guy is in France now and we have our marriage certificate from Seville, Spain.

Also, do I have to go through my company or can I do it myself? I mean, does my company have to do any kind of paperwork to bring him here?

    Thank you very much!

    Hi,
I have exactly the same problem, did you have news from that ?
The difference is I was issued a L1 visa one year ago but the project was cancelled and I still didnt use it BUT there's a new project coming up in the next few months.
We are not married but if he could get a L2, we can get married.
Does my company have to do something or can my partner just apply by himself with my old documents ?
    Thx for your reply !

I still haven't brought my husband to the U.S. but I have more clarity on this now. My attorney told me that my company doesn't have to do any paperwork. He can show up at the U.S. Consulate in France or India with the marriage certificate, a copy of my passport and visa, and my L1B approval notice and seek a stamp. This simplifies the process and we will be starting it soon.
