  • Change of status L1-->B2-->L1-->H1

    I'm currently on L1 visa and my project is ending in Oct. I already have a valid B2 visa and I wish to stay with my husband on B2 visa for 2-3 months. After which I want to resume back to L1 status and then gradually apply a H1.

    I want to know:

    1) Is it safe to switch the status L1-B2-L1
    2) Do I have to go back to home country and then enter again on a B2.
    3) Can I change my status from L1-B2 by staying in US.
    4) Will this have any impact on my H1 application which I'm planning to file next year.

    Please let me know.

    Thanks in advance.

    What's your husband status in US? On what visa is he in US?

        Then you would have better chances of moving successfully to H4 than to B2. You should file L1 to H4 COS or L1 to B2 COS before your last working day to avoid going out of status.

        It will also be easier to go from H4 to L1 than from B2 to L1 later in the future.

        This is my opinion not legal advice.

          Thanks Raghvi. I had earlier planned to move to H4 but I came to know that if I do COS to H4 then my current L1 will not be valid. Please help me understand if I move to H4 then will I have to file a L1 again in case I get a project from my current employer.
