    Hi,

    I came to US on September 2010 with L1A blanket Visa and worked for a client A until June 2013 (Was not in US for couple of weeks in the month of Jan 2013). I have now moved to a new client B. Visa is expired but continuing to stay with I 94 as its valid until April 2016.My company is not ready to process green card.

    1) With this information would you provide available options to apply for a green card.
    2) what are my options if Client B is ready to employee me directly under their payroll

    1. Green card can be initiated by any future employer.
    2. On L1A you can work only with current employer. If you want to get hired by your client B you will have to move to H1 visa.

    You can initiate GC with your client on the basis that they will be able to provide employment to you in the future. Parallely continue working with your current employer on I94. Next year ask your client to I intimate an H1 in April 2014, and if approved, you can work directly for the client on H1 from Oct 2014.

    As for GC, on L1A you are eligible to apply under EB1, but as your employer is not willing to process your GC there is hardly anything you can do. If you are not on L1A your eligibility as well as client's requirement for EB1 while you are on H1 will have to be assessed separately.
