  • Extension for L1 Blanket (Specialized Knowledge) visa rejected... What are the option

    Hi

I had L1 Blanket Visa... The company had filed for extension, however, it was denied... So i had to travel back to home country

    My Questions are

    1. Can L1 Individual be applied ?
    2. When can the company re- apply for L1 B
    3. Once a visa is rejected, is there any duration for which re- application cannot be made?
    4. IS there any chance of H1- B before the next April quota?
    5. Can you suggest any other / best option ?
    6. What is difference between L1- B Specialized Knowledge, L1 - A, L1 Individual

    Appreciate your help

    1. Yes that could be the next option.
    2. Any time, but if applied immediately with no change in documentation the rejection chances are high.
    3. No duration as such but unless you have additional documentation/evidences better to avoid.
    4. Not unless you have had a previous H1 approval in last 6 years.
    5. Apart from L1/H1 no other option.
    6. Read http://www.immihelp.com/l1-visa/

This is my opinion not legal advice.

      Hi

Thanks a ton...Can you please provide me advise on below queries
      1. If L1 - Blanket is rejected, will that affect the approval of L1 Individual... Is the probability of L1 individual getting rejected more ?
      2. In ideal scenario, how much time/ months should i wait to re- apply L1 Blanket....(my visa was rejected 2 months back)
3.In ideal scenario, how much time/ months should i wait to apply L1 Individual (my visa was rejected 2 months back)
      4. In present conditions / market, is the rejection rate high for L1 Individual or L1 Blanket ? Which of the two has higher rejection rate ?
      5. Regarding the difference between L1 Blanket , L1 B- A, L1 Individual.. the link does not provide answer to that....I tried to research, but i am not able to get the difference between them... Can you please explain ... that will be helpful
      6. What is difference in processing (process flow) of L1 Blanket and L1 Individual ?
      7. If i have B1/ B2, can i travel for short term....Will my L1 Blanket rejection, affect my travel on B1/ B2

      Appreciate your help

        1. It shouldn't.
        2. For reapplying L1 Blanket if you have additional documentation or material fact then can apply immediately if not its better to apply only if there is any change in underlying specialization details. A lot depends upon why the L1B was rejected in the first place.
        3. L1 Individual petition approval may take a few months if applied under normal processing so you should be good.
        4. No such data is available in public domain. But I would say L1 Individual has higher chances of success than L1 Blanket.
        5. L1 B and L1 Individual are for specialized skill sets, L1A if for Managers and senior executives. Blanket petitions need only I129S, whereas Individual petition have to be approved by USCIS first. L1B can be valid for 5 Years, L1A can be valid for 7 years. L1A holders can apply GC under EB1 category. There are lot of difference, do you have any specific question?
        6. For L1B Blanket it is like a pre approved petition for the employers who qualify, like a blanket approval for employees without necessity of applying petitions and getting approval for each and every employee.
L1 individual needs a new petition to be approved by USCIS for each individual. L1 Blanket requires professional degree.
        7. Yes you can but dont work on B1/B2 and advisable not to stay for more than 2-3 weeks.

This is my opinion not legal advice.
