  • Paycheck during out of state

    Hello,

My L1B visa and I94 (and driving license) has been expired already. My L1B visa extn has been denied today.

I understand that i cannot work any more and my employer cannot bill his customer starting today.

I was told that i will have to leave the country in 30 day max. My plan is to exit in 2 weeks

I was told by my employer that during this 2 weeks stay i will not be paid and it is illegal ?
THough i do not generate revenue for my employer i still have my expenses to take care of before i leave

Can you please share your opinion or view point on this topic

    Thanks !

Sorry to learn about your visa, Maya.

Once a visa has been declined, no employer would want to invite trouble of running the payroll for that candidate. I hope he is not asking you to work without pay.

You can stay for a couple of weeks and you should then leave. Someone i know, filed for H1B in Feb 2012, his I94 was till Mar 2012. He got an RFE in Feb 2012 with a response time till May 2012. He responded in May 2012 and his visa was declined in Jun 2012. He got the update on email, he then waited 10-12 days for the physical notice to reach him. And, upon receiving the physical notice, he left in 2-3 days.

    I hope this helps.

    Cheers,
These are my personal thoughts. I am not a professional.

    Wishing you luck.
