Apply EAD for L2 with valid I94 only and L1/L2 visa is expired

HI,

I had my L2 visa and i94 till aug 2013. Now my I94 got extended till Feb 2016 same as my spouse's date of I94.Primary applicant's petition L1 is not going to be extended as he has the valid I 94 till 2016 Feb.

My question is can I apply for EAD for L2 with valid I94 only? Please note I am applying for the first time.
