  • Question about L1B/L2

    My situation is holding B1 Visa in US for two months, will be transferred to L1B in the earliest.

    My questions are:

    - If I transfer from B1 visa to L1B Visa in US, can my family members transfer from B1 visa to L2 visa in US too? Any disadvantage like I can not re-enter to US? Does it impact my further US visa applying if any in future?
    - If I and my wife has valid Canada visa, can we go to Canada to apply for L1B and L2 instead of US or China?

    Looks like I need summarize my questions:

    1. Any disadvantage transfer B1 to L1B in US? Like I can not re-enter US during L1B or applying any visa in future? or I can not sponsor L2 for family members?

    2. May I enter to Canada for applying L1B visa, in case company has a office in Canada?

        Hello, Xiajun.

        Yes. The provision to switch visas from B1 to work visa exists. But, the consulate does not take it very nicely when someone enters on B1 and does a Change of Status to H1 or L1. You could try stamping from Canada too.

        I am not saying that this is not possible (Change of Status from B1 to L1), but it is generally frowned upon when you go for L1 stamping. Many candidates have been able to get the stamping approved - they entered on B1 and then the client filed for their H1. They returned to India after 1 odd year and went to the consulate for stamping - and it was approved. But, they were asked a lot of questions on why did they switch the visa, why did they not come back and get the right visa etc.

        I do not know about China but there are quite a few stamping issues in India so people prefer going to Canada for stamping.
