  • Should I apply L1B immediately after L1A is rejected?

    Hi,

I got my L1A VISA rejected in Oct 2013 and my company is planning to file L1B immediately. What are the chances of getting L1B VISA in chennai?
I have total 7 years of exp with designation as Development Team Lead.

What are the chances of it getting approved? Will it affect on my B1 VISA?

Technically you can. But requirements of L1A and L1B are different. Your immigration team should have avoided sending you for L1A with 7 Years Exp and TL role. It might have been acceptable 5-10 Years back not nowadays.

This is my opinion not legal advice.

Should I apply L1B-immediately after L1A is rejected

My Company still wants to reapply with L1B. I have spent 2 years in this company. There are tools which are developed by the company which I have worked a little. But what are the chances that the L1B will be approved? Because L1A is rejected just now. Will it affect the B1 status? Also, where I was working before this company was bought by my current company. So my client is still same since last 7 years.

      Please guide.

reapplying as L1B after L1A rejection

10 months after L1A VISA rejection, my company is again reapplying for L1B. I work as a Team Lead and have 8 years of experience with the same client. i have been to US just a month back for a month on B1. What are the chances? What care should I take this time?

The details you have provided are too little to be able to assess the claim of a L1B visa. Merely spending 8 Years with same client is not enough proof of specialization.

If you and your immigration team are confident of your specialized skill set I would say go ahead.

This is my opinion not legal advice.
