  • L1 B Extension - I-94 date is clerical mistake ?

    Hello All,

My L1B is expiring on Jan 20 2014, and I noticed my I -94 is valid till Jan 20 2015. I was under impression that we dont need to extend the visa till my i-94 expiry.

Following are the points in question

    1. In case I don't extend my visa before expiry, it will be a new L1B petition when I next go to India, need to go thru the same pain for the next L1B petition to get approved.

    2. L1B extension is simple, easy to get stamped in US consulate back in India when compared to a new petition

    3. I-94 date should be same as Visa date, any other date in I-94 is simply a clerical mistake

    4. DDS (DMV) will not renew your driving license, they don't consider the I-94 date, they look the visa validity

    5. No Loan (eg: car Loan) will not be approved when your visa is expired (even though your I-94 date is not expired)

Any points on this is really appreciated, Thanks

My take on your points based on my experience:

    1. Yes. Been there, done that...

    2. I wouldn't say "simple" when dealing with visa related matters. See item #1. Expect delays ;-)

    3. Yes. My wife had a similar issue, and we went to back to a USCIS deferred inspection site right next to the airport to have it fixed.

    4. Yes. DMVs don't care about what's is written on your I-94. I had to renew my driver's license last month, and they didn't ask for my I-94.

    5. I managed to spend seven years in the U.S. without taking a loan, but I would say yes on this one...I know that for mortgages they ask if you're U.S. citizen or not. When you say no, they ask about your visa expiration date, and then you can expect higher interest rates and closing costs especially if you're taking a 15 year or 30 year loan.

      Thanks for your points,

One the extension is done, is that mandatory to go and get stamped (L1B and L2B) in a particular time frame or we need to get the stamping done only if travel outside(home country in my case) US ?
