  • L1B Extension queries (Work and Stay Period)

    Hello,

My L1B Visa and I-94 expired on 19th Apr 2013. My company applied for extension before the I-94 expiry date. I did get RFE and my company's lawyer submitted it on 17th Sep 2013. I am awaiting decision from USCIS.

Now, the grace period of 240 days is going to end on 19th Dec 2013. I have few questions :

    1. My company mentioned that I can work for these 240 days or till the USCIS decision (whichever is earlier). I hope there is no issue in this. Also, when I leave US, I hope I wouldn't face any problems. Please confirm
    2. Suppose my extension request gets rejected, how many days will I get to stay in US post the rejection date. Can I still stay till 19th Dec 2013, even after the extension request gets rejected?
    3. Can I work post the rejection date until I leave US?

    Please advise.

    Thanks!

    1. Technically this understanding is correct. You should typically not face any problems.
    2. The rejection notice will say so. You typically will be given a week to 10 days to leave. You cannot stay past that date. No you cannot stay till 19 Dec 2013 in such a scenario.
    3. No you cannot.

This is my opinion not legal advice.
