I'm looking for some information about the L1 Visa process. I'm of Indian origin, but I have been working out of Shanghai, China for the past 15 months. I was sent on deputation from my company in India. I have been working in this company for more than 2 years (including my Shanghai experience). I have worked in the same company for one year in India before I was deputed to Shanghai. I would like to gauge my options:
1) Am I eligible to apply for the L1 in the US consulate in Shanghai? There was a case in my own company where my colleague applied for a B1 visa after 1 month of arriving here and his application was rejected citing it was too early for him to apply from Shanghai.
2) Should I go back to India and apply for an L1? If that's the case, I do know that the applicant should have worked for the same company for 1 year at least in the 3 years preceding to the application. But, I also hear that there is a rule where I should have worked for 10 months in the country from which I'm applying L1 just before the application. Is it really mandatory or have I misunderstood?
