  • L2 dependent Visa query

    Hi,
    Me and my wife are working for the same company in India. I am currently in US on L1B. The company also applied for her L1B visa but that was rejected. Can some one please help me with the below:-
    1)Can she apply for L2(Dependent Visa) immediately. I am in US.Since her L1B was rejected few days back,will there be any problems with her L2 Blanket Visa processing?
    2)She is planning to apply for EAD ,once her L2 is approved and she is in US. IS it possible after sometime to apply for L1B while she would be working on L2 in US?

    1. Yes. I dont think it will be any problem.
    2. Yes she can but most likelihood L1B will again be scrutinized and chances of rejection are similar if not higher.

      1)How log does it take it to Apply and receive EAD?- is there any limit to how long she can work on EAD?
      2) is the process of conversion of L2 to L1 as cumbersome as in India- Interview and stuff like that?

      lastly, in case the visa interviewer asks my wife if she will is thinking of applying for EAD and working what should be her answer- as her L1 is rejected?- wouldnt it give a message that L1 is denied but intention is to work in US and hence taking the L2 route

        1. Normally 2-3 Months. I think you can request for interim EAD after 90 Days of no action. You will have to check with the lawyer. She can work as long as she has a valid EAD and you maintain a valid L1 status, and you have a valid I-94 and she has a valid I-94.
        2. There may not be an interview a sit would be a COS (Change of Status from L2 to L1) but there may be documentation required to prove her specialized skill sets.

        Merely getting an L2 doesn't guarantee an EAD. Also, not all L2s apply for EAD. But at the same time to work one needs EAD while on L2. She can mention that she will think about it after getting an L2.

          Ok,
          last question. Apologies in advance if it sounds silly but needed to ask this
          IS it possible for her to work from Home (while she is in US awaiting for EAD)- for her India Project?- this would mean not getting salary but merely working from Home

            If she is not getting paid by any means anywhere in the world it will be fine. But if she is going to get paid for this in India then it is illegal without first getting an EAD.

              Hi,
              is it possible that my wife comes to US on L2, applies for EAD and goes back to India for her project. She can come back once the EAD is approved and start working here

                  1)Which is faster(online vs paper application)?- In case of paper application- how much s the fee payable and how do i deposit the fee?
                  2)Where are the centers for Bio metrics located?- since i am currently staying in a hotel and might have to shift to a different location. Is that a problem?
                  3) My wife had applied for L1 Blanket Visa in November which got rejected- can she apply for EAD (within few days of reaching USA?). Is Bio metrics needed for every one?

                          Will applying L2 along with L1 Blanket complicate the process?

                          What is advisable?
                          My husband is applying for L1 (blanket petition)? Should L2 be applied at the same time or once his is approved?
                          How much does it usually take (L2 process)?
