  • Can a submission of a I12 form (l1a visa) extend my stay?

I came in the us and my passport states that i need to leave before the 8th of december. However i just submitted an I129 form for an L1A visa. My L1A is currently under review. I should get an answer back by the 18th of December.

If you were in my shoes, would you still leave to your foreign country before the 8th of december, or would you stay until you get the answer back from the USCIS

This is a very vague question. Why a COS to L1a was submitted few days before your stay end date? Every person's case is different as there are numerous parameters to consider especially for L1A, one of the complex and most scrutinized visa types out there. If you would provide more details such as type of visa you are in currently, purpose , experience, managerial/executive skills , something can be suggested.

If not applied in premium L1 visas can take upto 6 Month to get a decision so with only 3 Days left to Dec 8th I honestly would not recommend overstaying.

This is my opinion not legal advice.

Raghvi, thank you for your reply,

It has not been long that I'm here. The company i work for opened a couple of branches in the US and asked me to lead the marketing division. We applied for an l1a however the uscis demanded additional evidence. Im currently in the mindset of putting together a second document with all the evidences requested. I made sure i would get a response in the next 2 weeks (premium response).

However while awaiting for the answer, i would need to extend my stay. (an extra 5-6 days until i get the answer)
