    Hi,

    Please can someone suggest about this issue.

    To apply for L1 - B from a company named X. Do I need to work in this company for 365 days?
    I couldn't find any such rules
    If there is any such thing, please someone can give me a link for this.

    To qualify, the named employee must also:

    Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States;

      Thanks for taking time to reply.

      One doubt whether it qualifying organization or an employee?

      Another thing is, if an employee is working in abroad why he will be going for L1 - B instead of H1 - B.

        Your Question is not clear. The Employee should be working for the Employer(Organization) at a location outside US continuously for at least 1 Year.

        L1s and H1s have different requirements and uses. To name a few:

        L1B dont have any numerical limitations (unlike the 65K +20K- US Masters, for H1b) , can be applied any time as against H1s whose quota open only on 01-April of the year and close as soon as all the numbers are filled. This year H1 Cap closed within April 5th 2013. I am expecting similar for 2014 too.
        L1s dont have any educational/salary requirements hence are scrutinized more stringently. L1s dont actually require a client letter as such to prove employment. H1s will require you to prove the contracts between all the layers with suitable client letters and agreements.

        L1 can be applied any time. For H1 you have to wait till April 2014 to apply and one can work on that H1, if approved, only after 30-Sep-2014.
