Reopen H1B expired petition

Hi

My H1B visa validity 10/1/2008 to 09/28/2011.

I haven't visited US consulate due to my personal problems (i.e. i had not utilized the visa)..

1) Shall my H1B can be extended through same employer or Shall I open the H1 petition from other employer also.

2).What is the procedure need to follow.

3).Presently I am working on L1.

1. It can be utilized by any employer.
2. First find a genuine employer, Tell the next employer that you have an earlier approved H1 petition and the employer can file an cap exempt H1 petition using this approval notice. The employer's attorneys should be able to take it from there on.
3. You have to be careful of certain points; if you do a L1 to H1 as a COS (Change of Status) then once the COS is approved you should only work with H1 employer. Thats the reason you should do COS for a good employer not for some random company which makes empty promises to get you a project and get lured by them and then later on regret moving from L1 to H1.
