COS from L1 to H1B under CAP exempt?

I am currently on L1 in US. I have an expired H1B Visa (Jan 2006) and have utilized only 4 months. Please let me know if H1B COS is possible under H1B CAP Exempt?

2006 was more than 6 Years back. Generally if one was in H1 status in last 6 Years then under remainder option one could re capture the time if entire 6 Years of stay was not utilized. You might want to double check with am immigration attorney in order to ascertain if the 2006 petition can be re opened.
