  • L1B Blanket - Readmission into U.S when visa is valid only for 5 more months

    Hi,
I am working in the U.S on L1B Blanket visa. Visa is valid until June 1, 2014. I94 is valid until September 2015. I have stayed in the U.S for a period of nearly 2 years. I am planning to go to India on vacation by Feb 1, 2014 and return by Feb 17, 2014.

Since my visa is valid only until June 1, is there any chance that I will not be allowed to enter U.S back on Feb 17?

Will I be given I94 only until visa expiry date?

I am planning to bring my spouse here as my deoendant on L2 and apply EAD for him. I understand that L2 visa expiry date will be based on L2 visa expiry date.So in this case, it will be June 1, 2014. If his EAD and I94 dates are greater than L2 visa expiry date, does that mean he can work in U.S until both I94 and EAD ends? Or should he go back to India once L2 visa expires?

    Thanks for your help.

You can travel as long as your visa is valid. So you would be allowed entry. Now whether you would get I94 till June 2014 or beyond depends on the officer at the port of entry.
As for your spouse, he will get L2 based on your L1/ I94. So the visa will most probably be till June 2014. Now, as for EAD it will depend upon his I94/your I94 whichever is the earliest one. He cannot work beyond that even if he has a valid L2 visa.

This is my opinion not legal advice.

Thanks Raghvi. My husband's L2 interview is scheduled with the consulate on Jan 22 nd. But I need to travel to India before he comes, due to a personal reason. Is it ok if he enters U.S on L2 when I am in India on vacation? Will this be checked at the port of entry? He wants to come early so that he can start EAD processing as soon as he arrives.

Now when his EAD is being processed, I might reenter U.S say on Feb 17th. If my i94 changes, will it be considered for EAD? Or will US CIS consider my I94 at the time of EAD application?
