  • L1-A vs H1B visa

    Hi ,
    My employer given two options for me to apply visa in L1A or H1 B ..

    which is the better option can you please suggest.

    H1B - my employer planning to apply in 2014 - I can travel in Jan 2015

    L1A - planning to apply in Jan/Feb 2015. - if everything goes well will travel in Feb 2015

    what are the chances of rejecting L1 A visas ? if the company is newer are they need to fill the L1 A bracket ?

    your help is much appreciated

    Each category has its merits and demerits, and truly speaking shouldnt be used interchangeably as each visa has a different purpose. On L1A, if approved, there is an outside chance that, you may be able to apply GC in EB1 Category and get GC quicker. But on L1 visa, you cannot change employer. And L1As arent easily approved.
    Nevertheless, if you want it to look simplistically, I would say apply H1 in April 2014, if approved, dont immediately go for stamping. Apply L1A instead, if approved and stamped travel on L1A, and try to convince your company to file GC . Also, you would have an approved H1 petition, so technically, you cna use that to shift to any other employer in future.

    Newer companies wouldnt be by default having L1 Blanket approved, as one needs to consistently send people ( I think 50+ every year) successfully on L1 visas in order to apply for a blanket status from USCIS.
