  • L1B to H1B

    Hi All,

Currently I'm working on L1B and recently I got my extension also. I spent around 3 year's in US on My L1B Visa..
I had H1B visa in past, approved in 2008 and still showing as Approved. But I haven't done stamping on My H1B Visa.
It is possible I can Change of status to H1B Visa. Is there any rule first I have to do stamping then only I can Change my status.

    Please advise me.

    Thanks
    Bunty

I believe one can re use the H1 for upto 6 Years from its initial validity, or upto 6 Years from last maintained H1 status. So probably till 2014 you may be able to re use it. Nonetheless, L1+H1 can at max be for 6 Years, so if at all the H1 can be reused it would be approved only for 6 Years Minus time already spent on L1 status.

This is my opinion not legal advice.

Thats means I don't have to go for stamping?

Not required if L1 to H1 is applied as COS and approved.
